According to federal law, specific symbols or information, known as a "legend," are required to be printed on the labels of certain medications to ensure their safe use. These are known as legend drugs, and they can only be dispensed by a pharmacist with a valid prescription from a licensed healthcare provider.

Despite the widespread availability of CBD products in stores and online, the U.S. Food and Drug Administration (FDA) has not approved the sale of most non-prescription CBD products as foods or dietary supplements. This creates a complex regulatory environment where consumers can indeed purchase over-the-counter items, but under a cloak of federal and state-level ambiguity.
